		<description><![CDATA[Los Angeles clothing manufacturer American Apparel has settled litigation stemming from an employment lawsuit.]]></description>
			<content:encoded><![CDATA[<p>Los Angeles clothing manufacturer American Apparel has settled litigation stemming from an employment lawsuit.  The Equal Employment Opportunity Commission (EEOC) filed a <a href="http://www.larryhparker.com/practice-areas/employment-law/employment-discrimination/" target="_blank">disability discrimination</a> lawsuit against American Apparel after it fired an employee who was on medical leave for the treatment of cancer.  </p>
<p>American Apparel settled the lawsuit for $60,000.  $40,000 of the settlement will be awarded to the discrimination victim, while the rest of the money will be used to sponsor educational seminars about the Americans with Disabilities Act (ADA).  American Apparel has since adopted policies that place it in accordance with the rules of the ADA.</p>

In Iowa, a judge has ruled that a woman was eligible for unemployment insurance after resigning from her job because her employer held a contest, with a $10 prize, for guessing which employee would be the next to be fired.</p>
<p>According to the judge, the &#8220;employer&#8217;s actions have clearly created a hostile work environment by suggesting its employees turn on each other for a minimal monetary prize.&#8221;  Many employees quit after they saw the contest memo.</p>

			<content:encoded><![CDATA[<p><strong>Employment law</strong> dictates what potential employers may or may not ask of potential employees.  Legal website <a target="new" href="http://blogs.findlaw.com/law_and_life/2010/08/10-things-you-cant-be-asked-at-a-job-interview.html">FindLaw</a> recently published some questions that are completely out of bounds in job interviews.  Knowing what questions you don&#8217;t have to answer can help to avoid any awkward situations in an interview.</p>
<p>A good rule of thumb is that personal questions are not permitted.  Outlawed personal questions can include&#8230;</p>
<ul>
<li>How old are you?</li>
<li>What race are you?</li>
<li>Are you pregnant or thinking about becoming pregnant?</li>
<li>Are you physically or mentally disabled?</li>
<li>What religion do you practice?</li>
<li>What is your sexual preference?</li>
<li>Any recent illnesses?</li>
<li>Do you smoke?  Drink?</li>
</ul>
<p>None of these questions are allowed in interviews, as they do not pertain to the job or how well any applicant may perform at the job. 			<content:encoded><![CDATA[<p>The U.S. recession has led to much belt-tightening at companies across the country.  As the unemployment rate has shown, a lot of that belt-tightening comes in the form of lay-offs and downsizing.  Too often, and maybe even unfairly, older workers have been feeling the pinch at an alarming rate.  The Equal Employment Opportunity Commission (EEOC, the government agent that enforces rules banning employment discrimination) recorded a 33 percent increase in the number of age discrimination complaints during the height of the recession.</p>
<p>Older workers are often assumed to have higher pay, be prone to illness, are on the verge of retirement, and even have difficulty learning and executing new skills.  These assumptions themselves are tinged with discrimination.  Because of these discriminatory beliefs, older workers often find themselves first on a company&#8217;s chopping block.  These workers may also find it much more difficult to find a new position, even with extensive qualifications, which can also be due to <a href="http://www.larryhparker.com/practice-areas/employment-law/employment-discrimination/">age discrimination</a>.</p>

		<description><![CDATA[Often, teens seeking summer work have never worked in a place of business before, and are not only unaware of their rights in the workplace, but are also unaware of proper workplace behavior.]]></description>
			<content:encoded><![CDATA[<p>With the school year ending or already at an end, many teenagers will begin searching for summer employment.  Often, teens seeking summer work have never worked in a place of business before, and are not only unaware of their rights in the workplace, but are also unaware of proper workplace behavior.  These factors can lead to a vast under-reporting of sexual harassment by teenagers, either because they are <strong>too embarrassed to report the harassment</strong>, they are <strong>not aware that they can or do not know how to report sexual harassment</strong>, or may <strong>not even realize they are being harassed</strong>.</p>
<p>According to the Equal Employment Opportunity Commission (EEOC), in 2009, only 237 sexual harassment claims were filed for individuals aged 19 and younger.  Some experts estimate that the actual numbers of harassment incidents involving teenagers is around 200,000.  This extreme level of under-reporting does no favors to anyone, especially to the victims themselves.  If you or a loved one knows a teenager who may have been harassed at work, be sure to let him or her know that he or she has legal rights.</p>
<p>Actions against corporations where sexual harassment involving teens has occurred have previously been successful.  Recently, Burger King settled a lawsuit for $85,000 after charges of unwanted touching and sexual advances (that were seemingly ignored by management when the teenage victim complained) and Ruby Tuesday settled a sexual harassment claim for $225,000 after a general manager subjected teenage females to graphic remarks and propositions.  </p>
